Membership cancellation and consumer rights: what gym owners need to know
Members on plans of a year or longer can leave at any time, and refunds are due within 15 days. Here's what Turkish consumer law says to gym owners and what's still unclear.

When a member says "I want to cancel", the first instinct at many gyms is to look for the early-exit fee in the contract. In Turkey that question is now mostly settled by consumer law, not by the gym. Most gym memberships fall under the subscription contract definition in Consumer Protection Law No. 6502, and that has a direct effect on your cash.
This post covers what the rules say as of October 2026, where they're still unclear, and how GamGym applies them in the panel.
Why a gym membership counts as a subscription
Article 52/1 of Law 6502 defines a subscription as a contract where a service is provided continuously or at regular intervals. A membership that gives ongoing access for a set period fits that definition. We haven't found a Court of Cassation ruling that settles it, but practitioners read it the same way.
Visit packs, PT packs and credit packs fit less well. They look more like a prepaid service bundle, and the rules for them are less clear.
Outside telecom and energy, only some articles of the Subscription Contracts Regulation apply: 5, 6, 7, 8, 13, 22, 23, 24 and 25 (Art. 2/2). The commitment articles aren't among them. So whether a gym can charge an early-exit fee is uncertain. Don't rely on that clause.
One year or longer: the member can leave at any time
An open-ended membership, or one lasting a year or more, can be ended by the member at any time, without a reason and without a penalty (Reg. Art. 22/1). The law says "longer than a year" and the regulation says "a year or longer", so a 12-month membership is very likely covered. If you sell 12-month plans, this rule sits right in the middle of your daily work.
Shorter memberships are different. The member can end them only if the gym changed the terms or there's a valid reason that prevents use, such as moving away or a health problem. Otherwise the gym may refuse (Art. 52/4, Reg. Art. 22/2).
The deadlines: 7 days and 15 days
Termination takes effect within 7 days at the latest, and nothing can be charged after that. The unused prepaid part is refunded in full within 15 days, and the gym confirms the termination in writing or on a durable medium (Reg. Art. 24–25).
A worked example: you sold a 12-month membership for 12,000 TL upfront. The member wants out at the end of month four, and the request takes effect seven days later. About 236 days remain, which works out to a refund of roughly 7,750 TL.
How the request is received matters too. Notice is given in writing or on a durable medium. The gym can't make cancelling harder than signing up, and it has to keep a channel open that accepts requests at all times (Art. 52/4, 52/6, Reg. Art. 22/4, 23/3). Telling someone who joined online to "come to the front desk to cancel" is risky.
Automatic renewal is also off the table. A fixed-term membership can't renew itself; an extension needs the member's request or consent (Art. 52/3, Reg. Art. 13).
Online sales: a 14-day withdrawal right
If the membership was sold online, the Distance Contracts Regulation applies as well. The member has 14 days to withdraw, counted from the contract date for services (Art. 9). If the pre-sale information is incomplete, that period can stretch to a year.
One exception covers services that start, with the consumer's consent, before the withdrawal period ends (Art. 15/1-h). If the membership starts on the purchase day, relying on this exception means getting an explicit "start immediately" consent at checkout and recording it. Turkish law has no pro-rata payment like the EU: it's either a full refund or no withdrawal.
What's still unclear
Ask your own lawyer about these:
- whether a 12-month membership counts as "a year or longer" (very likely yes),
- whether visit, credit and PT packs are subscriptions at all,
- whether a gym can charge anything to a member who leaves early,
- whether the 15-day refund clock starts on the request date or the effective date.
Below a certain amount, disputes must go to the Consumer Arbitration Committee first.
How GamGym applies these rules
In GamGym a gym can't switch cancellation off. It picks one of two modes: apply requests instantly, or review them. On every open membership the member sees "End membership" in the member portal, and before sending gets a summary: the latest end date, the estimated refund, which future installments will be cancelled and what debt remains.
In review mode the gym has 7 days. If nobody decides, the request is accepted automatically on day seven. For open-ended memberships and those of 12 months or more there's no reject button at all. Shorter memberships and packs can be refused only with a written reason, and the member is told about the right to apply to the Consumer Arbitration Committee.
The refund is pro rata: remaining days for timed memberships, remaining units for packs. Future installments are cancelled, and any unpaid amount for the period already used stays as debt. If the gym records a deduction it must give a reason, and the panel notes that deductions are legally contested. The 15-day refund deadline is tracked in the panel.
Online sales get a separate 14-day withdrawal path with a full refund. If the buyer ticked "start immediately" at checkout, the time and the text version of that consent are stored and the withdrawal path closes. Both sides are notified at each step, and the member gets a printable confirmation page. GamGym has no automatic renewal.
The same flow runs when a member closes their whole GamGym account: a termination request opens automatically for every open membership they hold with you, any debt stays in your ledger, and upcoming bookings are cancelled without penalty. Their name, phone and e-mail stay on your member record so the confirmation and refund can reach them.
We cover the sales side in selling memberships online and record keeping in GDPR-style data rules for gyms (KVKK). The full panel is on the for gyms page, and the topic-by-topic comparison is in Why GamGym?.
If you take your contract and this post to a lawyer, the first line they'll question is the one that charges a fee for leaving a 12-month membership.

Frequently asked questions
Can a member on a 12-month plan cancel?
The regulation says memberships of a year or longer can be ended at any time without a reason or penalty, and a 12-month plan is very likely covered. Termination takes effect within 7 days and unused prepaid fees are refunded within 15 days.
Is there a withdrawal right for memberships sold online?
Yes, the Distance Contracts Regulation gives 14 days. If the membership starts on the purchase day and the buyer explicitly agreed to start immediately at checkout, the exception can be argued, so that consent should be recorded.
Can a gym refuse a cancellation request in GamGym?
Not for open-ended memberships or those of 12 months or more. Shorter memberships and packs can be refused with a written reason, and if the gym doesn't decide within 7 days the request is accepted automatically.
